Sherif filed a suit asking the court to tell her ex-husband, who bears the same name as his father, ex-Vice President Atiku Abubakar, to allow their sons to be in her custody.

The presiding Judge, Bashir Danmaisule, on October 27, 2020, delivered the judgment in favor of Maryam Sherif.

However, Nasir Saidu, lawyer to Sherif, returned to the court, complaining that the defendant has refused to comply with the court order.

Saidu urged the court to invite the defendant to explain to the court while he should not be jailed for disobeying the court judgment.

On Thursday, both Abubakar and his lawyer, Abdullahi Hassan, were absent in court despite the court bailiff stating that the summon was served to the defendant through his workplace, the Nigeria Customs Service, on November 3, 2020.

Saidu urged the court to issue an order for Abubakar to be arrested and detained in jail until he obeys the court’s judgment.

He recalled that the defendant has, on several occasions, floated the court order to bring those children in court during the hearing of the case.

The Judge, Bashir Danmaisule, noted that the defendant has refused to appear in court despite being served with the notice.

Bashir cited section 29 of the Federal Capital Territory Abuja, Area Courts (Repeal and Enactment) Act 2010, issued an arrest of the defendant, Alhaji Atiku Abubakar.
